The promoter is: Nura Operations Pty Ltd whose registered office is at PO BOX 95 Brunswick VIC 3056, Australia.

The competition is open to residents of Australia, United States, United Kingdom and select other territories aged 18 years or over except employees of Nura and their close relatives and anyone otherwise connected with the organisation or judging of the competition.

By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.

All Nura Chance to Win Competitions will only accept one entry per person. While multiple entries from the same person are not discouraged, we will only accept the total entries as one.

Closing date for entry will be as stated. After this date, no further entries to the competition will be permitted.

No responsibility can be accepted for entries not received for whatever reason.

1. The promoter reserves the right to cancel or amend the competition and these Terms and Conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.

2. The promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition. All third party prizes offered are governed by their own Terms and Conditions, as outlined by the relevant third party provider.

3. The prize is as follows: One of 20 Nura Bluetooth 5.3 Audio Transmitters: ARV of each individual prize: USD$59.00.

The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

1. Winners will be chosen at random by an allocated software system, from all entries received and verified by Promoter and or its agents.

2. The winner will be notified by email and/or direct message on Facebook, Instagram, Twitter or any other relevant Social Network, and/or letter within 28 days of the closing date. If the winner cannot be contacted or they do not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

3. The promoter will notify the winner when and where the prize can be collected/is delivered.

4. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.

5. By entering this competition, an entrant is indicating his/her agreement to be bound by these Terms and Conditions.

6. The competition and these Terms and Conditions will be governed by [English] law and any disputes will be subject to the exclusive jurisdiction of the courts of [England].

7. The winner agrees to the use of his/her name and image in any publicity material, as well as their entry. Any personal data relating to the winner or any other entrants will be used solely in accordance with current data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

8. Once the prize is received, the winner will need to share a picture of the prize to the Social Network in which they used to enter the competition. Nura reserves the right to share this image, and the image will only be used in conjunction with Nura's Privacy Policy.

9. Entry into the competition will be deemed as acceptance of these Terms and Conditions.

10. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, Twitter or any other Social Network. You are providing your information to Nura and not to any other party. Nura‘s decision as to those able to take part and selection of winners is final. No correspondence relating to the competition will be entered into.

Nura shall have the right, at its sole discretion and at any time, to change or modify these Terms and Conditions, and such change shall be effective immediately upon posting to this webpage.

Nura also reserves the right to cancel the competition if circumstances arise outside of its control.

United States Policy

OFFICIAL RULES

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS PROMOTION. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. Subject to all federal, state, and local laws, regulations, and ordinances. Promotion begins at 12:00:00 AM Eastern Time ("ET") on March 23, 2024, and ends at 11:59:59 PM ET on April 20, 2024 (The “Promotion Period”). Void outside the 50 United States and the District of Columbia, and where prohibited by law. The Promotion is sponsored by Nura Operations Pty Ltd. (“Sponsor”).

2. ELIGIBILITY: The Nura Promotion (the “Promotion”) is open to any legal U.S. residents currently residing in the 50 United States including the District of Columbia and who are at least eighteen years of age as of the date of entry (herein “entrant(s)” or “participant(s)”) who are active subscribers to the NuraNow subscription program. Employees, officers and directors of Nura Operations Pty Ltd. or any of its subsidiaries, affiliates, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, and members of their immediate families (spouses, parents, siblings and children, regardless of where they live) and those living in the same household are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners.

3. TO ENTER: To participate, complete the entry form included in the monthly NuraNow Perks email. All entries must be received by Sponsor before the Promotion Period closes. Limit: one (1) entry per person. You must complete all required information to be eligible to enter to win the prize. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Entry must be submitted by the participant. Automated and bulk entries and entries by third parties are prohibited and will be disqualified. Any attempt by any participant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that participant’s entries and that participant may be disqualified at Sponsor’s discretion. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries or other errors or malfunctions of any kind whether, human, mechanical, electronic or otherwise. Participants do not need to make a purchase of any kind to enter or win. For alternative method of entry, please mail a 3x5 postcard that includes your name, address, phone number and email to be received by April 10 20, 2024 to the following address: Attention: Nura Promotion, PO BOX 95 Brunswick VIC 3056, Australia. Entries may be used by Sponsor as quotes or in social media channels or any other mediums for promoting the brand. Entry may be submitted by no one other than Participant.

4. SELECTION OF WINNER: Twenty (20) winners will be chosen from all eligible entries received. The winners will be selected through a random drawing. The winners will be announced no later than April 30, 2024. Winners will be notified by e-mail and/or regular mail and/or telephone within two (2) weeks after the winners are determined. Sponsor will mail the winners a prize claim form and a declaration and release for completion. The prize claim form and declaration and release form must be completed and returned to: Nura Operations Pty Ltd. PO BOX 95 Brunswick VIC 3056, Australia. Except where prohibited, the potential winner will be required to complete, sign and return the prize claim form and declaration and release form within fifteen (15) days of being notified or be eliminated and therefore ineligible to win any prize. If the potential winner fails to sign and return the prize claim form and declaration and release form within the required time period, or is unavailable to accept the prize within the time period specified by Sponsor, that potential winner will be deemed to have forfeited the prize, and an alternate potential winner will be selected in his/her place in a random drawing from all eligible entries received within seven (7) days of the date days of the date the potential winner is determined to be ineligible. If the winner is under the age of majority in their state of residence, the Prize Claim Form and Release must contain the winner’s consent and their parent or guardian’s written consent. Noncompliance with the foregoing, failure to abide by these Official Rules, or return of the prize notification as non-deliverable may result in disqualification and naming of an alternate potential winner. Up to two (2) alternate winner drawings will be held, after which any remaining prize will remain un-awarded. Alternate potential winner(s) must satisfy all eligibility requirements. Winning a prize is contingent upon fulfilling all requirements set forth herein. ARV of individual prize: $59.00. Prize Restrictions: Any and all applicable federal, state, and local taxes are the sole responsibility of the individual prize winner. Winner will be issued a 1099 tax form for the appropriate retail value of prize. Prize cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion. Prize cannot be used in conjunction with any other promotion or offer.

2. GENERAL CONDITIONS: This Promotion is governed by the laws of the United States. Void where prohibited by law and outside the United States. This promotion is in no way sponsored, endorsed, administered by, or associated with third parties. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, NURA RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Participation in the Promotion constitutes entrant’s full and unconditional agreement to these official rules and to Sponsor’s decisions, which are final and binding on all matters relating to the Promotion. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. If, for any reason, the Promotion is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (c) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of California or the appropriate State Court located in California; (2) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys’ fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased.
